Effective rostering for Australian businesses

A well-planned roster is essential for managing labour costs, ensuring adequate coverage, and maintaining compliance with the Fair Work Act and relevant modern awards. Under most awards, employers must provide rosters at least seven days in advance (and in some cases 28 days), and changes to rosters require reasonable notice.

Key rostering considerations include maximum ordinary hours (usually 38 per week), minimum shift lengths (often 3-4 hours), rest breaks between shifts (typically 10-12 hours), and penalty rates for weekends, public holidays, and shifts outside ordinary span of hours. Getting these wrong can lead to underpayment claims and Fair Work investigations.

Rostering obligations under Australian Modern Awards

Australian employers have specific legal obligations around rostering that vary by award. The Clerks Private Sector Award requires rosters to be posted at least seven days in advance, while the Hospitality Industry General Award requires 14 days' notice. Under the Manufacturing and Associated Industries Award, continuous shift workers must receive their roster 28 days ahead. Changes to a published roster generally require the same notice period, or the employee's agreement. The right to request flexible working arrangements - available to parents, carers, people with disability, and employees over 55 - can also impact rostering decisions, and unreasonable refusal of such requests is now subject to Fair Work dispute resolution.

Shifts scheduled on weekends and public holidays attract penalty rates that can double or triple the ordinary hourly cost.
